SMS Program Terms and Privacy Notice
This SMS Program Terms and Privacy Notice describes the text-messaging programs offered by Ocho Lacrosse, LLC, doing business as Charlotte North Lacrosse (“Charlotte North Lacrosse,” “CNL,” “we,” “us,” or “our”).
It explains the types of messages we may send, how consent works, how to stop receiving messages, and how we collect, use, disclose, retain, and protect information associated with our SMS programs.
This notice supplements our Privacy Policy and Terms of Service. If this notice conflicts with either policy concerning our SMS program, this notice will govern with respect to that program.
1. Our SMS Programs
Charlotte North Lacrosse may offer the following text-messaging programs:
Account and Service Messages
These messages relate to a member’s account or use of Charlotte North Lacrosse services. They may include:
Identity-verification reminders
Account verification or security messages
App access instructions
Membership and subscription notifications
Customer-support communications
Changes affecting an account or service
Other administrative or informational messages
Account and service messages are non-promotional.
Promotional and Marketing Messages
If you separately opt in to receive promotional texts, we may send messages concerning:
Charlotte North Lacrosse news and announcements
Programs, clinics, events, and training opportunities
Memberships and subscriptions
Products, merchandise, and special offers
Community updates
Surveys, contests, and promotions
Other marketing communications from Charlotte North Lacrosse
Consent to account and service texts does not automatically constitute consent to receive promotional texts. Promotional SMS consent must be provided separately.
2. Consent to Receive Messages
By providing a mobile phone number and completing the applicable SMS opt-in process, you consent to receive the categories of messages described in the consent disclosure presented to you.
Your consent applies only to the Charlotte North Lacrosse SMS program and message categories for which you opted in.
Consent to receive promotional text messages is not a condition of:
Purchasing a product or service
Creating or maintaining an account
Obtaining a Charlotte North Lacrosse membership
Accessing the Charlotte North Lacrosse app or community
Participating in an event or program
Providing a phone number without completing the applicable SMS opt-in process does not, by itself, constitute consent to receive promotional text messages.
Where required by law, Charlotte North Lacrosse will maintain records of SMS consent, including the date, time, source, applicable disclosure, phone number, message category, and opt-out history.
3. Automated Messages
Messages may be sent using an automated telephone dialing system or other automated technology. Your consent to receive automated promotional messages is not a condition of purchase, membership, or access to our services.
4. Message Frequency
Message frequency varies depending on:
Your account activity
Whether identity verification or another account action is required
The programs in which you participate
The promotional SMS preferences you select
The number of relevant announcements, events, or offers
We do not guarantee a specific number of messages.
5. Message and Data Rates
Message and data rates may apply according to the terms of your mobile service plan. Charlotte North Lacrosse does not charge a separate fee to receive SMS messages, but your wireless carrier may impose charges.
You are responsible for any charges assessed by your mobile carrier.
6. How to Opt Out
You may withdraw your SMS consent at any time by replying STOP to a message from Charlotte North Lacrosse.
After submitting a STOP request, you may receive one final message confirming that you have been unsubscribed. Following confirmation, we will not send additional SMS messages unless you subsequently provide new consent.
A STOP request may apply to all Charlotte North Lacrosse SMS messages associated with the sending number, including both promotional and account/service messages. If you still need assistance with your account after opting out, contact us by email.

Opting out of SMS messages will not affect your account, purchases, membership, subscription, or access to Charlotte North Lacrosse services.

8. Mobile Carriers and Delivery
Wireless carriers are not responsible for delayed or undelivered messages.
Message delivery depends on your mobile carrier, network availability, device, and other circumstances outside our control. Charlotte North Lacrosse does not guarantee that every message will be delivered or received.
We may change the telephone number or short code used to operate the program. Where required, we will notify participants of a change. Messages sent to an old number or short code may not be received.
Not all mobile devices or carriers may be supported.
9. Eligibility and Responsibility for the Mobile Number
By enrolling in an SMS program, you represent that:
You are the subscriber or customary user of the mobile number provided, or you are authorized by that person to enroll the number;
The information you provide is accurate; and
You will notify us if you stop using or controlling the number.
If your mobile number changes or is reassigned, you must opt out or contact us so that messages are not sent to the number’s new owner.
10. Children and Parental Consent
Charlotte North Lacrosse serves youth athletes, including children under the age of 13. We take children’s privacy seriously and operate our SMS programs in accordance with the Children’s Online Privacy Protection Act and Rule (“COPPA”) where applicable.
Children Under 13
A child under 13 may not independently enroll a mobile phone number in a Charlotte North Lacrosse SMS program.
Before collecting, using, or disclosing a mobile phone number or other personal information from a child under 13, Charlotte North Lacrosse will:
Provide direct notice to the child’s parent or legal guardian describing the information we intend to collect and how it will be used and disclosed;
Obtain verifiable parental consent, except where a limited COPPA exception applies;
Collect only information reasonably necessary for the child to participate in the applicable service;
Allow the parent or guardian to review the child’s personal information;
Allow the parent or guardian to request deletion of the information;
Allow the parent or guardian to refuse further collection or use of the information; and
Protect the confidentiality, security, and integrity of the information.
For members under 13, CNL should generally collect and use a parent’s or legal guardian’s mobile number for SMS communications rather than the child’s number.
A parent’s consent to account or service messages does not automatically constitute consent to receive promotional messages. Promotional SMS consent must be presented separately and must be optional.
Users Ages 13 to 17
Users between 13 and 17 should enroll in an SMS program only with the involvement and permission of a parent or legal guardian. When appropriate, Charlotte North Lacrosse may direct SMS enrollment and consent requests to the parent or guardian.
Parental Rights
A parent or legal guardian may contact Charlotte North Lacrosse to:
Review personal information collected from their child;
Request correction or deletion of that information;
Revoke previously provided consent;
Refuse further collection or use of the child’s information; or
Ask questions about our children’s privacy practices.

We may take reasonable steps to verify the identity and authority of the person making a request before disclosing or deleting a child’s information.
11. Information We Collect Through the SMS Program
Depending on how you interact with the program, we may collect:
Your mobile phone number
Your name and account identifier
Whether the number belongs to a member, parent, or guardian
The member’s age or age range when needed to apply appropriate privacy protections
Your SMS consent selections
The date, time, source, and method of consent
Copies or versions of the consent disclosure presented
Messages sent to or received from your number
Delivery, failure, and engagement information
HELP, STOP, and other keyword requests
Opt-out and resubscription records
Device, carrier, and country information
Information you voluntarily provide through text messages
Records necessary to investigate complaints or demonstrate legal compliance
We do not knowingly collect more information from a child than is reasonably necessary for the child to participate in the relevant activity.
12. How We Use SMS Information
We may use SMS-related information to:
Deliver the messages you agreed to receive;
Verify member identities;
Administer and protect member accounts;
Provide app access and customer support;
Send promotional messages when separate promotional consent has been obtained;
Record and honor consent and opt-out choices;
Respond to questions and requests;
Monitor delivery and program performance;
Prevent fraud, misuse, and security incidents;
Maintain records required by law, carriers, or service providers; and
Comply with legal and regulatory obligations.
We will not use a child’s personal information for purposes materially different from those described in the direct parental notice without providing a new notice and obtaining any additional parental consent required by law.
13. How We Share SMS Information
We do not sell or rent mobile phone numbers or SMS consent information.
We do not share mobile phone numbers or SMS opt-in data with third parties or affiliates for their own marketing or promotional purposes.
We may disclose SMS-related information:
To Mailchimp and other service providers that help us administer and deliver our SMS program;
To identity-verification, hosting, security, analytics, and customer-support providers where necessary to support our services;
At your direction or with your consent;
To comply with applicable law, regulation, subpoena, court order, or lawful government request;
To investigate fraud, misuse, security threats, or violations of our policies;
To protect the rights, safety, and property of members, Charlotte North Lacrosse, or others; or
As part of a merger, financing, acquisition, reorganization, or sale of assets, subject to appropriate privacy protections.
Service providers may use SMS information only to perform services for Charlotte North Lacrosse and must protect it appropriately.
Where COPPA applies, we disclose a child’s information only as described in the direct notice provided to the parent or guardian and as authorized by the parent’s verifiable consent, unless disclosure is otherwise permitted or required by law.
14. Mailchimp
Charlotte North Lacrosse uses Mailchimp as an SMS service provider. Mailchimp may process mobile numbers, consent information, message records, delivery information, and opt-out requests on our behalf.
Mailchimp’s processing of information is also governed by its applicable terms and privacy documentation. Our use of Mailchimp does not permit Mailchimp or another party to use SMS opt-in information for its own unrelated marketing purposes.
15. Retention
We retain SMS information only for as long as reasonably necessary to:
Operate the SMS program;
Provide the services requested;
Maintain account and consent records;
Honor opt-out requests;
Protect our legal rights;
Resolve disputes; and
Meet legal, carrier, platform, and audit requirements.
Consent, opt-out, and messaging records may be retained for the period required by applicable law or industry requirements, which may extend for several years after a person leaves the SMS program.
When information is no longer reasonably necessary, we will delete it or render it non-identifiable using reasonable measures designed to protect against unauthorized access or use.
16. Security
We use reasonable administrative, technical, and physical safeguards designed to protect SMS information against unauthorized access, loss, misuse, alteration, or disclosure.
No method of electronic transmission or storage is completely secure. We therefore cannot guarantee absolute security.
17. Changes to This Notice
We may update this notice to reflect changes in our SMS program, service providers, practices, or legal obligations.
We will post the revised notice on this page and update the effective date. If a change materially affects how we collect, use, or disclose personal information from a child under 13, we will provide direct notice to the parent or guardian and obtain new verifiable parental consent when required by COPPA.
Continued participation in the SMS program after an update does not replace any consent that applicable law requires us to obtain separately.
